California Public Utilities Commission
505 Van Ness
San Francisco, CA 94102
Dear Mr. Clark:
Subject:
Rejection during Probation
The Concerned
Staff Committee was informed that a new hire of the CPSD was rejected
last week. The staff was hired in February, 2003.
The Concerned
Staff Committee would like to know the following:
Did you approve
and sign the Letter of Rejection?
Did you know whether the affected staff’s Due Process Rights
were respected before the termination?
Did Mark Ziering initiate the rejection process?
Did you assess/ evaluate the Educational and Professional background
of Mark Ziering vis-à-vis that of the dismissed staff?
Did you receive advice and recommendations in writing from George
Carazo, Director of Human Resources, and Patrick McDermott that
the rejection is proper and lawful because the relevant /governing
DPA RULES were followed?
Did Attorney Diana Lee review the process and OK it?
We believe that you have professional Law Enforcement background;
therefore we expect you to adhere to DPA RULES.
Do not take
this enquiry as Personal. We are just investigating the Commission’s
rejection of five NEW HIRES during probation. What we uncover would
form the basis for a formal presentation to Gray Davis, Governor
of California.
