Subject:
California Constitution Article 5. Sec1. The Governor shall see
that the Law is faithfully executed.
Steve
Larson, Executive Director of the California Public Utilities Commission
revealed to CPUC Staff that he has created two new posts of Deputy
Executive Directors and that he has appointed (effective January
1, 2005) Paul Clanon and (effective December 6, 2004) Laura Doll
to the new positions (Larson’s Memo of 12-17-04 attached).
The Clanon and Doll appointments are in violation of California
Code of Regulation §548.40. Competitive Examinations (copy
attached).
Everything was done in secret. Staff only got wind of it because
Steve Larson’s memo informed CPUC staff on December 17, 2004
that the he (Larson) appointed Doll and Clanon to the new deputy
executive director positions. Please note that Laura Doll has been
on the job since 12-06-04.
This
is not acceptable to the staff and also to other qualified interested
candidates. Larson and his boss President Peevey must comply with
the laws of employment of the State of California. To avoid lawsuits,
the Concerned Staff Committee and What Now?! Request that you remedy
these improper appointments and that you impose sanctions on Steve
Larson and President Peevey.
The Concerned Staff Committee requests that the sanctions mandated
in Government Codes Sections 19680, 19681, 19682, 19683, and 19684
be enforced.
In addition, the adverse action mandated in Government Code Sections
19572, 19583.5, or 19682 must be taken.
We
want to assure you that for you to succeed in reforming the State
Government of California you need the input of members the Concerned
Staff Committee who are ready to bring to your notice the many incidents
of gross incompetence, gross misconduct and blatant inefficiencies
produced especially by Senior Managers of the State Bureaucracies.
The
Concerned Staff Committee believes that these latest improper appointments
were calculated to derail your California Performance Review Efforts.
We as members of the staff could smell the rat in this self imposed
internal reform. They are good in creating distortions; but we are
not going to let them fool you.
