Creation of Deputy Executive Directors for the Commission: is the creation in compliance wirh PUC CODES and the State of California Government Codes on Classification and Compensation, and Public Announcement of vacancies.

Dear Mr. Steve Larson:

The Concerned Staff Committee would like to know whether you believe that your just announced December 17, 2004 of the creation of new posts of Deputy Executive Directors is legal and lawful and not arbitrary.

We would like to know why the Commission appoints Assistant Executive Directors-see PUC CODE 308 but you can create and appoint individuals to a Deputy Executive Director? Why one has more power and authority? The Assistant Executive Director or The Deputy Executive Director?

The Commission appoints the Executive Director and Assistant Executive Directors but not the Deputy Executive Director? We have not seen anywhere in the PUC CODE provision for Deputy Executive Directors.

This Deputy Director position first appeared during Loretta Lynch regime but we understand because of pressures about it is legality it was shelved.
Now was the creation of the Deputy Executive Directors position approved by the Dept. Of Personnel Administration?

Was the proper hiring exams procedures(Government code19889.3) followed as required by State government code 19889.3?

We would like to know also if your were directed by the Governor's office to make these new posts and new appointments?
